Terms of Service

1. Acceptance of Terms

By accessing or using the ForgeWay application at forgeway.app ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and ForgeWay LLC ("ForgeWay," "we," "us," or "our").

2. Description of Service

ForgeWay is an AI-powered IT troubleshooting assistant that helps users diagnose and resolve technology problems through guided conversation. The Service uses Anthropic's Claude API to generate responses.

ForgeWay is not a professional IT services provider. The Service offers AI-generated suggestions and guidance, not professional IT consulting, repair services, or certified technical support. No employer-employee, contractor, or professional-client relationship is created between you and ForgeWay.

3. Account Registration

To use certain features of the Service, you must create an account. By registering, you represent and agree that:

  • You are at least 13 years of age. Users between 13 and 18 must have the involvement of a parent or guardian.
  • You will provide accurate and complete registration information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You will maintain only one account per person. Creating multiple accounts to circumvent usage limits or other restrictions is prohibited.
  • You will notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Attempt to extract, reverse engineer, or discover system prompts, model configurations, or other proprietary components of the Service.
  • Manipulate or attempt to manipulate the AI to generate harmful, malicious, abusive, or illegal content.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service.
  • Abuse, circumvent, or attempt to circumvent rate limits, usage quotas, or other technical restrictions.
  • Use the Service to gain unauthorized access to other people's systems, networks, or devices.
  • Use the Service to generate content that infringes on intellectual property rights of any third party.
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
  • Use automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable human usage.

We reserve the right to suspend or terminate accounts that violate these acceptable use requirements.

5. AI-Generated Content Disclaimer

This is the most important section of these Terms. Please read it carefully.

  • ForgeWay provides AI-generated suggestions, not professional IT advice. The Service is not a substitute for consultation with a qualified IT professional.
  • AI-generated responses may contain errors, inaccuracies, or outdated information. The AI does not have real-time access to product specifications, software updates, security patches, or current technical documentation.
  • You must verify all steps and suggestions before making any changes to your devices, systems, or networks. You are solely responsible for evaluating the accuracy, completeness, and usefulness of any AI-generated content.
  • ForgeWay is not liable for any hardware damage, data loss, security breaches, system instability, software corruption, network disruption, or any other harm resulting from following AI-generated advice.
  • You acknowledge that AI technology has inherent limitations and that the Service cannot guarantee correct, safe, or optimal solutions for every technical problem.

6. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORGEWAY LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO FORGEWAY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

IN NO EVENT SHALL FORGEWAY LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER FORGEWAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Indemnification

You agree to indemnify, defend, and hold harmless ForgeWay LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

8. Intellectual Property

The ForgeWay name, logo, and all related graphics, software, and service marks are the property of ForgeWay LLC. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

You retain ownership of the content you submit through the Service, including your conversation messages and any images you upload. By using the Service, you grant ForgeWay a limited, non-exclusive license to process your content solely for the purpose of providing and improving the Service.

AI-generated responses are provided for your personal use. ForgeWay does not claim ownership of AI outputs. AI responses are generated by a third-party AI model (Anthropic's Claude) and should not be relied upon as proprietary, copyrightable, or guaranteed-accurate content.

9. Billing and Subscriptions

ForgeWay offers free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

  • Auto-renewal: Paid subscriptions automatically renew at the end of each billing cycle (monthly or annually) at the then-current price unless you cancel before the renewal date.
  • Cancellation: You may cancel your subscription at any time through the "Manage subscription" option in your account menu, which opens the Stripe billing portal. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then.
  • Refunds: Subscription fees are non-refundable except as required by applicable law. If you believe you were charged in error, contact us at support@forgeway.app within 14 days.
  • Top-up credits: Message credits purchased as top-ups are non-refundable and do not expire while your account is active. Top-up credits are forfeited upon account deletion.
  • Price changes: We may change subscription prices with at least 30 days' advance notice. Price changes take effect at the start of your next billing cycle after the notice period.
  • Downgrades: If you downgrade or cancel, features exclusive to your previous tier (such as specialized agents or increased device limits) will become unavailable at the end of your current billing period.

10. Termination

ForgeWay may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may delete your account at any time by contacting us at the email address listed below. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to its conflict of law provisions.

12. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us at support@forgeway.app. We will attempt to resolve the dispute through good-faith negotiation for a period of at least thirty (30) days.

If the dispute cannot be resolved informally, you agree that it shall be resolved through binding arbitration conducted in the State of Georgia, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

Opt-out: You may opt out of this arbitration provision by sending written notice to support@forgeway.app within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in the State of Georgia.

Small claims exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against ForgeWay LLC.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
